In New Delhi, a bureaucratic argument over a single government form has grown into one of the most serious institutional standoffs India has seen in years, pitting the Supreme Court against the Election Commission of India (ECI) over changes to Form 6, the document citizens use to register as voters. The dispute centers on allegations that modifications to the form helped facilitate the deletion of tens of millions of names from the country's electoral rolls.

What began as a technical question about an online form has become a test of judicial oversight, institutional accountability, and the integrity of voter rolls ahead of future elections, with the opposition Congress party now demanding the removal of the Chief Election Commissioner himself.

How a Form Became a Flashpoint

The controversy centers on Form 6, the standard application Indian citizens use to register for the first time or update their entry in the electoral rolls. According to court proceedings, a revised online version of the form began requiring applicants to disclose whether their parents or grandparents had appeared in a previous electoral roll, specifically one connected to the Special Intensive Revision (SIR) process the ECI has been conducting.

That change did not go unnoticed by the Supreme Court. On Monday, the court issued a pointed clarification: "Any modified Form 6 has not been approved by us." The statement signaled that the judiciary had not sanctioned the addition of ancestry-related questions to a form meant simply to register voters, and the court subsequently sought official records from the Election Commission explaining how and why the change was introduced.

The remark landed with force. For an institution like the ECI, which is constitutionally mandated to conduct free and fair elections independent of political or judicial interference in its day-to-day operations, a direct suggestion from the country's highest court that it had overstepped its bounds or acted without proper authorization is a serious rebuke.

The Commission's Defense

The Election Commission has pushed back firmly, arguing that the core of Form 6 itself was never amended. According to the Commission's position, the disputed requirement asking about parents' or grandparents' presence on earlier rolls was not an unauthorized change to Form 6 but a separate declaration tied to the Statutory Instrument Regulation process. The ECI has repeatedly stressed this distinction as the dispute moved toward the Supreme Court.

That argument has not stopped the political fallout. After Congress leader Rahul Gandhi publicized allegations about the Form 6 changes, tying them to the Supreme Court's comments, the ECI issued what it called a "fact-check," describing his claims as misleading. The exchange illustrates how quickly a dispute over form design has become entangled with partisan combat, with each side accusing the other of distorting the record for political advantage.

A Parallel Battle in Mumbai

The Form 6 dispute is not confined to Delhi. In Mumbai, the Bombay High Court has been hearing a related case brought by a seven-member family from the Santa Cruz neighborhood who were removed from the draft electoral roll after changing their address. The Election Commission told the court that a deleted voter who had properly filed Form 6 had not made a "false declaration," an argument aimed at pushing back against claims that the Commission was using technicalities to justify mass deletions.

The case is a microcosm of a much larger problem. If a single family can be erased from the rolls over an address change despite submitting the correct paperwork, critics argue, it raises uncomfortable questions about how many of the 130 million deletions nationwide may have been avoidable or wrongful.

Congress Escalates, Demanding the CEC's Removal

For the Congress party, the Form 6 episode has become the latest evidence in a broader indictment of the Election Commission's conduct. Party president Mallikarjun Kharge and Leader of the Opposition Rahul Gandhi have led internal discussions on launching a nationwide campaign demanding two things: the restoration of eligible voters among the roughly 130 million names deleted from the rolls, and the removal of Chief Election Commissioner Gyanesh Kumar.

Calling for a sitting CEC's removal is an extraordinary step in Indian politics, reflecting how deeply the opposition believes the integrity of the electoral process itself is now in question. Congress has framed the deletions and the alleged unauthorized form changes that may have facilitated them as part of a pattern that disproportionately disadvantages voters from groups it considers its base.

What Is at Stake

The dispute cuts to the heart of a basic democratic guarantee: that eligible citizens are not quietly erased from the rolls that determine whether their vote counts.

India's electoral rolls are the foundation on which the world's largest democratic exercise rests. Any ambiguity over who controls changes to voter registration forms, whether the judiciary, the Election Commission, or some blend of both, threatens to undermine public confidence in a system that depends on being seen as scrupulously neutral.

The Supreme Court's demand for records from the ECI suggests the judiciary intends to investigate exactly how the disputed form language originated and who authorized it. Whether that inquiry results in findings of genuine overreach, a merely careless bureaucratic process, or vindication for the Election Commission's position remains to be seen. But with Congress now mobilizing nationally and a parallel case proceeding in Mumbai, the Form 6 dispute has outgrown its origins as a technical filing question and become a referendum on institutional trust at a pivotal moment for Indian democracy.
