NEW DELHI: India's Home Minister Amit Shah has announced that the ruling Bharatiya Janata Party (BJP) and its allies will implement the Uniform Civil Code (UCC) across every state governed by the National Democratic Alliance (NDA) before 2029, setting an ambitious deadline that reignites one of the country's most sensitive political debates. This push comes as coalition partners remain divided over a related but distinct issue: a proposed nationwide National Register of Citizens (NRC), particularly regarding whether 1951 should serve as the citizenship baseline in Manipur.

Shah's announcement signals that the BJP intends to make the UCC, a long-standing ideological commitment of the Hindu nationalist party, a defining feature of its governance in states it controls, rather than waiting for a national consensus that has so far proven elusive. The party is navigating delicate negotiations with coalition partners over the NRC, particularly the contentious question of whether 1951 should be treated as the baseline year for identifying citizens in Manipur.

A Long-Deferred Promise

The Uniform Civil Code, which would replace India's patchwork of religion-based personal laws governing marriage, divorce, inheritance and adoption with a single set of rules applicable to all citizens regardless of faith, has been a fixture of the BJP's political platform for decades. It is also enshrined in the Constitution's Directive Principles of State Policy, though as an aspirational goal rather than a binding mandate.

Supporters argue the UCC would advance gender equality and national unity by removing legal distinctions rooted in religious identity. Critics, particularly among Muslim organizations and some regional parties, view it as a vehicle for majoritarian imposition that threatens the personal law protections of religious minorities, especially Muslims, whose family law is currently governed by distinct statutory and customary frameworks.

Uttarakhand became the first state to implement a UCC in 2024, and the BJP has signaled its intent to expand the model to other states it governs. The NRC has already proven deeply divisive in Assam, where its 2019 implementation left nearly two million residents, many of them Bengali-speaking Muslims and Hindus, off the final list and facing uncertain legal status.

Extending the NRC nationally raises the stakes considerably, and Manipur has emerged as a particular flashpoint. Shah confirmed that discussions are underway over whether 1951, the year of India's first post-independence census, should serve as the cutoff date for determining who qualifies as an original inhabitant or legitimate citizen in the state.

The choice of baseline year carries significant implications. Manipur has been convulsed by ethnic violence since May 2023, largely pitting the Meitei community, concentrated in the Imphal Valley, against Kuki-Zo tribal groups in the hill districts. Questions of indigeneity, land rights and who counts as an "original" inhabitant sit at the heart of that conflict. Adopting 1951 as a baseline would carry significant implications for how various communities, including groups perceived to have migrated from Myanmar in more recent decades, are classified. Any decision risks being read by one side or another as validating or delegitimizing their claims to belonging in the state.

That the NRC's nationwide rollout and its Manipur-specific baseline remain subjects of negotiation, rather than settled policy, points to friction within the NDA itself. Coalition governance in India has historically required the BJP to temper some of its more ideologically charged priorities to accommodate regional allies wary of alienating local constituencies, particularly religious minorities and ethnic groups with their own competing claims to land and identity.

By contrast, Shah's confidence in setting a firm 2029 deadline for the UCC suggests the BJP believes it has more room to maneuver on that front within NDA-ruled states, where it typically exercises direct control, than it does on the NRC, which would require broader political buy-in and touches on more explosive questions of citizenship, migration and ethnic belonging.

The debate over uniform legal codes and citizenship baselines is not new to India's political fabric. Long before independence, colonial-era Punjab saw similar battles over separate electorates, communal representation and competing claims to political weightage among Hindus, Muslims and Sikhs, disputes that hardened communal identities well before partition. India's founding nationalists, from Dadabhai Naoroji onward, sought to insulate politics from religious and social questions precisely to prevent majority rule from being perceived as a threat to minority rights.
