Gujarat has become the second state in India to enact a Uniform Civil Code (UCC), after President Droupadi Murmu gave her assent to the legislation, following Goa, which has operated under a common civil code since the Portuguese colonial era. The move replaces religion-based personal laws governing marriage, divorce, inheritance and adoption with a single legal framework applicable to all residents regardless of faith, and it is likely to intensify a long-running national argument over whether India should move toward one civil code for all its citizens.

The Gujarat government, led by the Bharatiya Janata Party (BJP), had pushed the bill through the state assembly earlier this year, positioning it as a fulfillment of a long-standing ideological commitment. The Uniform Civil Code has featured in the BJP's election manifestos for decades, alongside the abrogation of Article 370 in Jammu and Kashmir and the construction of a Ram temple in Ayodhya; two goals the party has already achieved during its decade in power at the center.

A Constitutional Aspiration, Decades in the Making

The idea of a uniform civil code is not new to Indian political life. Article 44 of the Constitution, part of the Directive Principles of State Policy, directs the state to "endeavour to secure for the citizens a uniform civil code throughout the territory of India." Unlike fundamental rights, directive principles are not enforceable in court, but they are meant to guide governance and lawmaking.

India's constitutional framers were acutely aware of the country's religious diversity and the political sensitivities surrounding personal law. For decades after independence, successive governments left Hindu, Muslim, Christian and other religious communities to be governed by their own customary laws on family matters, even as a common Hindu Code was codified in the 1950s covering marriage, succession and adoption among Hindus, Sikhs, Jains and Buddhists.

Goa remained the lone exception, retaining the Portuguese Civil Code of 1867 after its liberation from colonial rule in 1961, a code that applies uniformly to all communities in the state. For much of independent India's history, Goa's example was treated as an administrative curiosity rather than a template, since it predated the Indian Constitution and was never actively extended elsewhere.

Why Gujarat's Move Matters

Gujarat's adoption of a UCC changes that calculus. As one of India's largest and most politically influential states, and the home state of Prime Minister Narendra Modi, Gujarat's decision carries symbolic weight far beyond its borders. It signals that the BJP intends to use state legislatures as proving grounds for a policy that has proven difficult to implement nationally, given the scale of opposition from religious minorities and some constitutional scholars.

Supporters of the UCC argue that it advances gender justice by removing disparities in inheritance and divorce rights that exist under various religious personal laws, particularly those affecting Muslim women. Critics, including several Muslim organizations and some civil liberties groups, contend that a uniform code risks eroding the cultural and religious autonomy guaranteed to minorities under the Constitution, and that it could be used to impose majoritarian norms under the guise of legal equality.

The debate over a uniform civil code sits at the intersection of two constitutional commitments that are often in tension: the directive to achieve legal uniformity, and the fundamental right to practice and propagate one's own religion, including its personal law traditions.

Other BJP-ruled states, including Uttarakhand, have already moved on similar legislation, with Uttarakhand implementing its own UCC. Gujarat's assent from the President suggests a coordinated push is underway, with party leaders likely to point to both states as evidence that the policy is both legally sound and politically viable.

What Comes Next

The practical implementation of Gujarat's UCC will be closely watched, particularly how the state handles the transition for communities currently governed by distinct personal laws, including Muslims, Christians and tribal groups with customary practices. Legal challenges are widely anticipated, given that courts will likely be asked to weigh the law against constitutional protections for religious freedom and minority rights.

Politically, the development hands the BJP a fresh talking point ahead of future state and national elections, reinforcing its narrative of delivering on long-held ideological commitments. For opposition parties and minority groups, it raises the stakes in a debate that is unlikely to be resolved through legislation in a single state, but rather through a prolonged contest over India's constitutional identity: whether the country's diversity is best protected through differentiated personal laws, or through a single code applied equally to all.
