Reported cases of child rape in India have risen fourfold over the past decade, according to data from the National Crime Records Bureau (NCRB), even as conviction rates have remained stubbornly low. This gap has renewed scrutiny of the country's ability to deliver justice to its youngest and most vulnerable victims.

The figures, drawn from the government's own crime statistics agency, point to a troubling paradox: more girls than ever are being identified as victims of sexual assault, yet the criminal justice system is convicting offenders at a rate that has changed little in years. Child rights advocates say the disconnect suggests the rise in reported cases may reflect not just an increase in incidents, but greater willingness among families to come forward, even as courts and investigators struggle to translate complaints into convictions.

A Widening Gap Between Complaints and Convictions

India introduced the Protection of Children from Sexual Offences (POCSO) Act in 2012, a law designed to fast-track cases involving minors, mandate child-friendly courtroom procedures, and impose stringent penalties on offenders. More than a decade later, the law's implementation tells a mixed story. While POCSO expanded the legal definition of sexual offences against children and made reporting mandatory for institutions such as schools and hospitals, the surge in registered cases has not been matched by a corresponding rise in successful prosecutions.

Legal experts point to a familiar set of bottlenecks: overburdened special courts, chronic delays in forensic testing, high rates of witness turning hostile under social or family pressure, and inadequate training among police handling sensitive cases involving minors. In many instances, victims and their families face years of delay before a case even reaches trial, during which time evidence can deteriorate and witnesses can be pressured into recanting testimony.

Child protection specialists have long argued that a rising number of reported cases is not necessarily bad news on its own. It can indicate that stigma around reporting abuse is slowly eroding. The real alarm lies in what happens after a complaint is filed.

Systemic Failures Under the Microscope

India's criminal justice system has faced sustained criticism for its handling of sexual violence cases more broadly, but the specific challenges in child rape cases are compounded by the vulnerability of the victims themselves. Children are often required to recount traumatic experiences multiple times: to police, medical examiners, and in court, without adequate psychological support. Special POCSO courts, which were meant to expedite trials, remain overwhelmed in several states, with case backlogs stretching into years.

Investigators and prosecutors also frequently cite gaps in the chain of custody for forensic evidence, delays in filing charge sheets within the legally mandated timeframe, and a shortage of trained child welfare officers who are supposed to accompany victims through the legal process. These procedural shortcomings, activists argue, create openings for defense lawyers to challenge the credibility of testimony, particularly when trials are delayed by years.

Calls for Structural Reform

Successive governments have announced measures aimed at closing the gap, including fast-track special courts exclusively for cases involving sexual offences against women and children, and amendments introducing enhanced penalties for the rape of children. Yet legal scholars caution that harsher punishments alone rarely address the procedural failures, chronic understaffing, and lack of victim support systems that determine whether a case survives contact with the courts.

Child rights organizations and legal reform advocates are pressing for a broader set of changes: dedicated funding for POCSO courts to clear backlogs, mandatory training for police and judiciary on handling child testimony, stronger witness protection mechanisms, and better coordination between medical, police and judicial authorities so that cases move swiftly from complaint to trial.

Without such reforms, experts warn, the rise in reported cases risks becoming a hollow statistic: evidence that more families are speaking out, but not that the state is delivering justice once they do. For the thousands of children whose cases sit unresolved in India's courts, the gap between reporting and conviction is not an abstract policy failure. It is the difference between accountability and impunity.
