A confrontation between India's opposition parties and the Election Commission of India (ECI) over the integrity of the country's voter rolls escalated in New Delhi this week, as the INDIA bloc filed a Supreme Court petition challenging the commission's handling of a nationwide voter list cleanup, even as the top court itself pushed back on claims about what it had already decided in the matter.

The dispute centers on the Special Intensive Revision (SIR), an ECI exercise to scrub India's electoral rolls of duplicate, ineligible or deceased voters ahead of a string of state elections. Opposition parties say the process has instead become a vehicle for arbitrary and opaque deletions that disproportionately strip marginalized voters, including Dalits, Muslims and migrant laborers, from the rolls without adequate verification or recourse.

A march halted, a petition filed

On Monday, a planned march by opposition leaders and supporters toward the Supreme Court in Delhi was halted before it reached its destination, with protesters pulling back from police barricades. Leader of the Opposition Rahul Gandhi arrived at the court premises shortly afterward, even as demonstrators had already withdrawn. Congress's legal team filed the petition on behalf of the INDIA bloc, a coalition of opposition parties, seeking the creation of an independent panel to audit the scale and pattern of deletions carried out under the SIR.

The petition reflects a broader anxiety within the opposition that the SIR process, rolled out ahead of assembly elections in several states, could be used to quietly reshape the electorate in ways that favor the ruling Bharatiya Janata Party. Opposition leaders have pointed to reports of large numbers of names vanishing from rolls in constituencies with significant minority or lower-caste populations, raising fears that legitimate voters are being disenfranchised under the guise of administrative housekeeping.

The Form 6 controversy

At the heart of the legal fight is a newly appended declaration to Form 6, the document used for voter registration and corrections to the electoral roll. The ECI has claimed that the Supreme Court previously endorsed this declaration as part of the SIR framework, specifically in connection with provisions affecting Scheduled Caste and Scheduled Tribe voters. Opposition lawyers have disputed that characterization, arguing that the commission is overstating judicial backing for a process that has not, in fact, been fully vetted by the courts.

The Supreme Court moved to settle that dispute directly. In a sharply worded clarification, the bench stated plainly that it had not yet adjudicated on the new Form 6 declaration and would take up the challenge to it on October 27. "Do not put words in our mouth," the court said, rejecting the suggestion that it had already blessed the document. The remark amounted to a rebuke of the ECI's public framing of the issue and signaled that the judiciary intends to scrutinize the SIR process on its own terms rather than defer to the commission's account of prior rulings.

Why the stakes are high

Voter roll revisions are not new in India, but the scale and timing of the current SIR exercise, conducted in the run-up to important state elections, have made it unusually contentious. Election rolls determine who can exercise the franchise, and any systemic errors or biases in how names are added or removed can tilt outcomes in closely contested races. The opposition's demand for an independent audit reflects a broader distrust of the ECI's neutrality, a concern that has deepened in recent years as opposition parties have repeatedly accused the commission of favoring the ruling party in its administrative decisions, from the scheduling of elections to the handling of model code violations.

For its part, the ECI has defended the SIR as a routine and necessary cleanup to remove duplicate and fraudulent entries from rolls that, in some states, have not been thoroughly revised in years. Commission officials maintain that the process includes safeguards, including notice periods and appeal mechanisms, for voters whose names are flagged for removal. Critics counter that those safeguards exist mostly on paper, and that poor and less literate voters, who are least equipped to navigate bureaucratic appeals, bear the brunt of wrongful deletions.

What comes next

The Supreme Court's decision to take up the Form 6 challenge on October 27 now looms as a pivotal moment. A ruling against the ECI's declaration could force the commission to revisit deletions already carried out under the SIR, potentially restoring voters to the rolls before upcoming polls. A ruling in the commission's favor, by contrast, would hand the ECI a significant legal victory and likely intensify opposition accusations that the institution meant to safeguard India's elections is instead undermining public confidence in them.

Either way, the episode has thrust questions of electoral transparency to the center of India's political debate, with the opposition framing the fight over voter rolls as nothing less than a battle over the basic integrity of the democratic process.
