India's Supreme Court has referred petitions challenging a 2023 law that governs how the Chief Election Commissioner (CEC) and Election Commissioners (ECs) are appointed to a five-judge Constitution bench, setting up a landmark test of the independence of the institution responsible for conducting elections across the world's largest democracy. The petitions, filed by the advocacy group Association for Democratic Reforms, Congress leader Jaya Thakur and others, argue that the law undermines the very safeguards the court had itself devised to insulate the Election Commission from political interference.

The 2023 statute, formally known as the Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, was enacted after the Supreme Court itself had ruled in March 2023 that a selection committee, comprising the Prime Minister, the Leader of the Opposition and the Chief Justice of India, should choose the CEC and ECs until Parliament passed a law on the subject. That interim arrangement was meant to fill a constitutional vacuum: Article 324 of the Constitution empowers Parliament to legislate on the appointment process, but no such law had existed for over seven decades of independence, leaving the executive with largely unchecked discretion.

Parliament's response, however, replaced the Chief Justice of India on the selection panel with a Union Cabinet minister nominated by the Prime Minister. The revised committee now consists of the Prime Minister, a Union Cabinet minister and the Leader of the Opposition, effectively giving the government two of the three votes. Critics argue this defeats the purpose of the original judgment, which was to create a broad-based, politically balanced mechanism insulated from the ruling party's control.

Why the Composition Matters

The petitioners contend that removing the judiciary from the selection process and substituting it with a government-appointed minister tilts the balance of power decisively toward the executive. Since the Leader of the Opposition can be outvoted by the other two members, the law, they argue, allows the ruling party to effectively handpick the officials who will oversee elections in which it is itself a contestant.

This is not a hypothetical concern. The Election Commission of India wields enormous authority: it can restrict campaign conduct, order re-polling, disqualify candidates and enforce the model code of conduct that governs the behavior of parties and candidates during elections. A commission perceived as beholden to the government risks losing the public confidence essential to free and fair elections, a pillar of India's constitutional democracy.

The question before the Constitution bench is not merely procedural. It goes to the heart of how India balances legislative supremacy with the judiciary's role in protecting institutional independence.

The Constitutional Stakes

The case raises a fundamental tension familiar to constitutional democracies: Parliament has the explicit power under Article 324 to legislate on appointments, yet the Supreme Court had earlier stepped in specifically because it found the absence of such a law to be a threat to free elections. Now that Parliament has acted, the court must decide whether the resulting law still honors the constitutional values, most notably the independence of the Election Commission, that prompted judicial intervention in the first place.

Legal experts note that a five-judge Constitution bench is typically convened for cases involving substantial questions of constitutional interpretation, signaling that the court views this matter as carrying implications well beyond the specific appointments process. The referral comes amid broader scrutiny of the Election Commission's internal functioning and its perceived responsiveness to concerns raised by opposition parties and civil society groups over voter roll accuracy, campaign finance enforcement and the scheduling of elections. Against this backdrop, questions about how the commission's leadership is chosen take on added significance: an appointments process seen as compromised could deepen doubts about the institution's impartiality at a moment when its credibility is already under pressure.

India's Election Commission has historically been regarded as one of the more robust democratic institutions, credited with managing elections involving nearly a billion eligible voters with relative order. Whether that reputation can be sustained will depend, in part, on how the Constitution bench resolves the question now before it: whether the 2023 law strengthens or subverts the independence that has long been the commission's defining institutional asset.
