Washington's envoy to India has said that President Donald Trump will decide within ten days whether to act on legislation that threatens 100% tariffs on India, China, and other nations, injecting a fresh dose of uncertainty into bilateral trade ties just as New Delhi announces it has sealed the first phase of a long-awaited trade agreement with the United States.

The timing could hardly be more delicate. India's Commerce Minister Piyush Goyal confirmed that the first tranche of the India-US trade deal has been finalized, with legal drafting now underway. Yet even as negotiators in New Delhi and Washington move to put the agreement into formal legal language, a separate and far more punitive measure is sitting on Trump's desk, one that could upend months of careful diplomacy.

A Bill With Unusual Bipartisan Muscle

According to the US envoy, the legislation threatening steep tariffs has already cleared the Senate with striking bipartisan support: 86 of the chamber's 100 senators voted in favor. Such a lopsided margin is rare in an era of deep partisan division in Washington, and it signals that lawmakers from both parties see economic leverage against countries like India and China as a political winner, regardless of the diplomatic complications it may create.

The bill's scope is sweeping. A 100% tariff would effectively double the cost of targeted imports, a level severe enough to function less like a trade adjustment and more like an embargo. For India, which has spent years trying to deepen commercial ties with the United States while also managing a complicated relationship with Russia and China, the prospect of being swept into tariffs aimed broadly at geopolitical rivals is an uncomfortable one.

Trump now has roughly ten days to decide how to proceed, according to the envoy. That short window leaves Indian officials, businesses, and trade negotiators with little time to assess how seriously to weigh the threat against the progress made on the bilateral deal.

The Trade Deal's First Phase

Goyal's announcement that the first tranche of the India-US trade agreement has been finalized represents a significant, if partial, milestone. Negotiations between the two countries have dragged on for years, complicated by disputes over agricultural market access, digital trade rules, and tariff disparities that both sides have long flagged as irritants.

With the substantive terms of this initial phase apparently settled, the work now shifts to legal drafting, the technical process of translating negotiated commitments into binding treaty language. That stage can itself take months, and it offers no guarantee that the deal will be insulated from the broader tariff legislation working its way through Washington.

Goyal also used the occasion to look beyond Washington, announcing that India's free trade agreement with the European Union is set to be signed in December and is expected to take effect in February or March. Taken together, the European and American tracks suggest India is pursuing a deliberate strategy of diversifying its trade partnerships at a moment when its relationship with the United States carries unusual uncertainty.

Why the Timing Matters

Trade between India and the United States has grown substantially in recent decades, evolving from a relatively marginal relationship into one of India's most important commercial partnerships. But that growth has never been free of friction. Washington has repeatedly criticized India's tariff structure as protectionist, while New Delhi has pushed back against what it views as pressure to open sensitive sectors, including agriculture, too quickly.

The current moment underscores how trade policy in Washington is increasingly shaped by competing instincts: the desire to finalize targeted bilateral agreements that reward cooperative partners, and a parallel appetite in Congress for blunt, across-the-board measures aimed at countries seen as strategic competitors or insufficiently aligned with US interests.

If Trump moves forward with the tariff legislation, India would face a difficult question: how does a country navigate being simultaneously treated as a trade partner worth a dedicated bilateral deal and a potential target of punitive, across-the-board tariffs designed with China primarily in mind.

For now, Indian officials appear to be proceeding on both tracks at once: finalizing the legal text of the US deal while also racing to complete the European agreement, a hedge that reflects just how unpredictable the next ten days, and the months that follow, could prove to be.
