A Pakistani naval vessel collided with an Indian warship in the North Arabian Sea on September 15, prompting India to summon Pakistan's envoy in New Delhi and lodge a formal diplomatic protest over what Indian officials called "unacceptable and unprofessional conduct." No major damage was reported to the Indian vessel, though the Pakistani ship, which had approached at high speed, sustained damage and returned to harbor. The Indian warship has remained deployed in the region.

The incident, though brief, has drawn scrutiny because it appears to violate the terms of a 1991 bilateral agreement between India and Pakistan that governs how the two navies must behave when operating near one another. Under Article 10 of that pact, warships from either country are barred from closing within three nautical miles of one another during routine operations at sea, a buffer designed to prevent precisely the kind of high-speed encounter that occurred this week.

What the 1991 Pact Was Meant to Prevent

The agreement, signed by India and Pakistan in the aftermath of decades of intermittent conflict, was one of several confidence-building measures the two nuclear-armed neighbors adopted to reduce the risk of accidental escalation. Alongside provisions covering airspace violations and prior notification of military exercises, the naval clause was intended to keep patrol vessels, warships and other military craft at a safe distance from each other in shared or contested waters, including the Arabian Sea, where both navies routinely operate.

India's account of the September 15 incident describes the Pakistani vessel maneuvering toward the Indian warship at high speed before the collision occurred. According to India's version of events, the encounter occurred well inside the prohibited three-mile zone and suggests an aggressive rather than accidental approach. Pakistan has not offered a detailed public account of the incident.

A Protest, Not (Yet) a Crisis

India's response so far has been measured: summoning Pakistan's envoy is a standard diplomatic tool used to register displeasure without escalating militarily. It falls well short of the kind of retaliatory posture India has adopted after more serious confrontations in the past. Still, the fact that New Delhi invoked the specific language of the 1991 agreement, rather than simply describing the collision as reckless, signals that India wants the incident treated as a breach of a formal bilateral commitment, not merely an unfortunate accident at sea.

That framing matters. Treaty violations, even minor ones, carry diplomatic weight that ordinary naval incidents do not. By invoking Article 10 explicitly, India is placing the burden on Pakistan to explain not just what happened, but why an agreement both countries have upheld, however imperfectly, for more than three decades appears to have been disregarded.

The Weight of History

India and Pakistan have fought three major wars since their violent partition in 1947, including conflicts in 1965 and 1971 that drew in Punjab and other border regions directly. The two countries have also endured decades of lower-intensity confrontation, from the Kargil conflict of 1999 to periodic skirmishes along the Line of Control in Kashmir. Naval incidents have historically been rarer than land or air confrontations, but they carry their own risks precisely because warships operate in international waters where the rules of engagement are less clearly bounded by fixed borders.

The 1991 agreement was part of a broader, if halting, effort by both countries to build mechanisms that could prevent misunderstandings from spiraling into larger conflicts. Those efforts have had mixed success. Even as trade and people-to-people contact between the two Punjabs (the historic heartland split by partition) have occasionally flourished during periods of political thaw, military and diplomatic relations have remained brittle, prone to sudden reversals whenever an incident like this week's collision occurs.

What Comes Next

For now, both governments appear intent on containing the fallout. India has not indicated it plans further retaliatory steps beyond the formal protest, and Pakistan has not issued a public rebuttal. But the episode is a reminder that even well-established bilateral agreements, ones designed specifically to prevent exactly this kind of encounter, depend on continued restraint from both sides to remain effective. A three-nautical-mile rule is only as good as the willingness of both navies to respect it, particularly in waters where mistrust runs deep and the margin for error at high speed is slim.

Whether this incident proves to be an isolated lapse or an early sign of renewed friction at sea may depend less on what happened on September 15 than on how both countries choose to respond in the weeks that follow.
