India's Supreme Court convened an extraordinary Sunday sitting to examine whether Delhi authorities had defied its own directions on protest restrictions, hours after police detained Aam Aadmi Party (AAP) chief Arvind Kejriwal and several other opposition leaders minutes after they issued a call for supporters to march on the capital.

The rare weekend hearing, assigned to a special bench of Justices Bagchi and Mohana, underscores the gravity with which the court is treating allegations that executive authorities in Delhi are sidestepping judicial oversight at a moment of rising political tension in the capital.

A Court Asked to Enforce Its Own Word

According to the petitions before the bench, authorities failed to comply with directions the Supreme Court had previously issued concerning restrictions imposed in Delhi. The decision to list the matter for hearing on a Sunday, a day on which the court does not ordinarily sit, signals that the judges consider the question of compliance urgent enough to warrant immediate attention rather than routine scheduling in the coming week.

Such emergency sittings are reserved for cases the judiciary deems to involve irreparable harm if left unaddressed. That the bench chose to act within hours, rather than days, suggests concern that the situation on the ground, involving detentions and curbs on movement, could not wait for the ordinary rhythm of court business.

Detentions Follow 'Dilli Chalo' Call

The immediate trigger for the court's intervention was the sequence of events surrounding the AAP's "Dilli Chalo," or "March to Delhi," appeal. Kejriwal and other party leaders were taken into custody within minutes of issuing the message, a swiftness that opposition figures have characterized as evidence of pre-emptive suppression rather than a response to any actual unrest.

Kejriwal was sharply critical of the security clampdown, accusing Prime Minister Narendra Modi and Home Minister Amit Shah of fostering what he described as an atmosphere of authoritarian rule in the national capital. The remarks escalate a long-running confrontation between the AAP, which governed Delhi for a decade before losing power, and the central government, which retains significant control over the capital's police and security apparatus through the Ministry of Home Affairs.

The detentions, coming just as the party sought to mobilize supporters, have become the central evidence cited in the petitions now before the Supreme Court. Petitioners argue that the speed and manner of the arrests amounted to a direct violation of the court's earlier orders governing how protests and restrictions in Delhi should be handled.

Why the Timing Matters

Delhi occupies a unique constitutional position in India: it is a union territory with an elected legislature, but policing and public order remain under the control of the central government rather than the city's own administration. This arrangement has repeatedly placed the AAP, which has controlled Delhi's local government, at odds with the central authorities over who has the final say on law and order, including the policing of protests.

That friction has sharpened since the AAP lost its hold on power in Delhi, with opposition leaders now arguing that the apparatus of the state is being used to stifle dissent rather than neutrally enforce public order. The detention of senior leaders within minutes of a political call to action, before any demonstration had even begun, is likely to feature prominently in arguments that the restrictions are being applied pre-emptively and selectively against government critics.

For the judiciary, the case poses a sharper test: whether its directions, once issued, are being honored by the executive in practice, or whether they can be quietly set aside when politically inconvenient. A finding that authorities disregarded the court's orders would carry implications well beyond this single episode, touching on the broader question of whether constitutional checks on executive power over protest and assembly are being respected in the capital.

The Sunday hearing itself, a departure from routine procedure, is being read by legal observers as a signal that the bench intends to move quickly to determine accountability, even as the underlying political standoff between the opposition and the Delhi administration shows no sign of easing.
