Burundi, a small East African nation still rebuilding from decades of ethnic conflict and civil war, has agreed to accept migrants deported from the United States, becoming the latest country to join a rapidly expanding network of "third-country" deportation agreements made possible by a Supreme Court decision temporarily upholding the Trump administration's policy.

The arrangement, confirmed Tuesday by Nancy Ninette Mutoni, a spokesperson for Burundian President Évariste Ndayishimiye, stipulates that Burundi will only accept deportees who have not been accused of crimes or terrorism-related offenses. Beyond that assurance, the announcement provided few specifics: no numbers of deportees, no timeline, and no disclosure of what, if anything, the United States is offering Burundi in exchange.

That opacity has become a defining feature of the third-country deportation program, which allows the U.S. government to send migrants, often people who have never set foot in the receiving nation and share no language, family ties, or cultural connection to it, to countries willing to take them. The policy cleared a critical legal hurdle when the Supreme Court sided, at least temporarily, with the Trump administration, allowing deportations to proceed to countries beyond a migrant's country of origin while litigation continues in lower courts.

A Legal Green Light With Few Guardrails

The Supreme Court's decision did not represent a final ruling on the legality or constitutionality of third-country deportations. It was, instead, a stay: a temporary permission that lets the administration proceed while the underlying legal questions remain unresolved. These include whether migrants are afforded adequate notice and opportunity to contest removal to a country they have never lived in.

Legal scholars and immigrant rights advocates have warned that this kind of provisional approval can have outsized real-world consequences. Once deportation flights begin and agreements with receiving nations are signed, the practical ability to reverse course, even if courts eventually rule the practice unlawful, diminishes sharply. People removed to unfamiliar countries may have little recourse if a later ruling finds the process violated due process protections.

"The concern is not just whether this is ultimately found legal," said one immigration attorney familiar with the litigation. "It's what happens to people in the meantime, while the system sorts itself out on their backs."

Burundi's Fraught History Raises the Stakes

Burundi's own history underscores why human rights organizations are watching these arrangements closely. The country spent much of the late twentieth century locked in brutal ethnic conflict between Hutu and Tutsi populations, including a 1972 uprising in which more than 100,000 Hutus were killed, and a civil war in the 1990s that displaced hundreds of thousands and left the economy in ruins. A fragile peace, brokered with the help of international mediators including Nelson Mandela, only began to take hold in the early 2000s, formalized through the Arusha agreements and a series of power-sharing arrangements between Hutu and Tutsi leaders.

While Burundi has seen relative stability in recent years under President Ndayishimiye, the country remains one of the poorest in the world, with limited infrastructure and social services. Rights groups have questioned whether such a nation is equipped, or even consulted with adequate transparency, to absorb migrants deported from the United States with no ties to the country.

Part of a Broader Pattern

Burundi's agreement follows similar arrangements struck with several other African nations, part of what has become a coordinated diplomatic effort by the Trump administration to secure deportation destinations for migrants whose home countries refuse to accept them or with whom the U.S. lacks standard repatriation agreements. Critics argue the strategy effectively outsources the consequences of stalled immigration negotiations to some of the world's least-resourced governments.

The absence of public detail has fueled suspicion that these deals are being negotiated with minimal congressional oversight or public accountability. Immigration advocates have called for the administration to release the full terms of agreements like the one with Burundi, arguing that taxpayers and the migrants affected deserve to know what commitments, financial or otherwise, are being made in their name.

For now, the Supreme Court's temporary stay means the program continues to expand even as its legal foundations remain unsettled. Whether Burundi and the other nations that have signed on will be the final word, or simply another chapter in an unresolved legal and humanitarian debate, depends on how lower courts ultimately rule on the due-process questions the high court left unanswered.
