There is a very old idea buried in Indian political thought, older than the Constitution, older than the Mughals, older even than most of the texts we call classical. The Digha Nikaya, one of the earliest Buddhist scriptures in Pali, tells a story of how kingship began: humans lived in relative harmony until private property produced quarrels, and quarrels produced chaos, so the people elected a chief and promised him a share of the harvest in exchange for maintaining law and order. It is, in effect, a social contract theory of the state a couple of millennia before Hobbes and Locke got credit for the idea. The point of the story is not that kings are bad. It is that the king's legitimacy flows from an agreement to serve a rule-bound function, not from personal loyalty to whoever appointed him.

India's Election Commission was designed on precisely that logic: an umpire whose authority depends on standing apart from the players. That design is now under visible strain, and the strain has a specific, traceable cause.

Fourteen objections, no answers

An Indian Express investigation reported that two of the three Election Commissioners, Sukhbir Singh Sandhu and Vivek Joshi, filed at least 14 formal objections over a ten-month period, arguing that certain decisions had been issued without their concurrence. The Commission's response has been to insist that differing views are normal but decisions are unanimous, and that all major calls, including on the Special Intensive Revision of electoral rolls, were agreed upon. Former election commissioners and the sitting Chief Election Commissioner have gone further, calling any non-majority decision-making wrong and illegal under statute, and demanding documentation to prove how disputed calls were actually made.

Set aside, for a moment, who is right about the paperwork. The very fact that this argument is happening in public, commissioner against commissioner, is itself the story. The Election Commission's authority has never rested on the plausibility of any single decision. It has rested on the presumption that its internal process is basically trustworthy, so that losers accept results without conspiracy theories. Rahul Gandhi, the Leader of the Opposition, has already dispensed with that presumption, calling the alleged pattern a crime against the Indian people and a direct attack on the Constitution, and accusing the Commission of complicity in what he terms vote theft. Whether or not that characterization survives scrutiny, the opposition's use of the phrase "invisible hand" to describe decision-making inside the Election Commission captures something real: an institution meant to be visible in its neutrality is now suspected of hidden influence.

The law that made this predictable

This is where the 2023 law comes in, and where the current controversy stops being a personnel dispute and becomes a constitutional one. The Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023 restructured the selection committee for the Chief Election Commissioner and Election Commissioners. Where the Supreme Court's 2023 interim arrangement had included the Chief Justice of India alongside the Prime Minister and the Leader of the Opposition, the new law replaced the Chief Justice with a Cabinet minister nominated by the Prime Minister, giving the government a built-in two-to-one majority on the panel that picks the umpires of Indian democracy.

Petitions challenging that law, filed by the Association for Democratic Reforms, Congress leader Jaya Thakur, and others, have been referred by the Supreme Court to a five-judge Constitution bench. During the hearings, Justice Dipankar Datta said the quiet part out loud: election commissioners nominated effectively by the Prime Minister cannot be expected to defy him. That is not a partisan jab. It is a structural observation any student of institutional design would recognize. You do not need to allege a conspiracy to worry about a selection process that removes the one independent check, the judiciary, and replaces it with a government-controlled majority.

History's answer to "who guards the guardians"

India has faced versions of this problem before, and its constitutional architects were unusually alert to it, precisely because they had watched imperial administration up close. British Punjab, for instance, was carved into six administrative divisions, each run by a commissioner and deputy commissioners, all British, roughly half drawn from the military, answering ultimately to London. For decades, distance imposed a rough independence: instructions from London took weeks to arrive, so the Government of India often had to act on its own judgment, with London superintending after the fact rather than directing in real time. That changed after 1870, when the submarine telegraph cable through the Red Sea collapsed the distance between London and Calcutta, and oversight became instantaneous, control tightened, and local discretion shrank. The lesson generalizes well beyond colonial telegraphy: independence often survives on structural distance, and evaporates the moment the appointing authority gains direct, continuous leverage over the appointed.

The framers of India's Constitution built the Election Commission to have that structural distance from the executive of the day. K.R. Narayanan, who would later become President of India, spent decades in a bureaucratic and diplomatic culture that prized institutional independence as a load-bearing wall of the republic, not decoration. The entire post-independence project rested on the belief, hard-won through the freedom struggle, that Indians would work out their own salvation through institutions accountable to the public rather than to a single office, in the words the nationalist leaders Tilak, Bipin Chandra Pal, Lala Lajpat Rai and Aurobindo Ghose used to describe swaraj. An Election Commission that a Prime Minister effectively staffs is a quiet inversion of that founding premise.

There is also a sharper, more uncomfortable precedent. Afghanistan's Amanullah declared war on British India in 1919 partly because the fear that had bound his predecessor Habibullah to British patronage, the fear of an intact Imperial Russia, had vanished with the Russian Revolution of 1917. Remove the external check, and previously constrained actors reassess what they can get away with. Institutions do not merely reflect the character of the people running them; they reflect the incentives the design permits. A committee with a built-in government majority is a design choice, not an accident, and Justice Datta's blunt remark is really a restatement of that Afghan lesson in a different register: remove the counterweight, and deference becomes the rational strategy for anyone who wants to keep their job.

What "unanimous" is hiding

None of this proves that Sandhu or Joshi were bullied into silence, or that the Commission's insistence on unanimity is a fig leaf. The Commission's own rebuttal, addressing Special Intensive Revision deletions, Form 6 procedures and voter database management point by point, is a reasonable attempt to show its work. It is entirely possible that disagreement over process is normal in any three-member body making thousands of decisions, and that "unanimous" simply means consensus was eventually reached after argument, which the Commission itself says is the case. Statutory law does require majority decision-making, and if that was followed, however messily, then the substantive complaint dissolves into a communications failure rather than a cover-up.

But the reason nobody outside the Commission can be confident which of these is true is exactly the reason the 2023 law matters. When the appointing mechanism is transparently independent, benefit-of-the-doubt is cheap: the public can assume good faith because the structure supports it. When the appointing mechanism is transparently not independent, every ambiguous internal dispute reads as evidence of capture, whether or not it is. The 2023 law did not create the current controversy over 14 objections and unrecorded dissent. It created the atmosphere in which that controversy cannot be resolved by anyone's reassurance, including the Commission's own.

The stakes of getting the umpire wrong

The Digha Nikaya's ancient chief was owed his share of the paddy only so long as he kept the peace impartially; the moment he became an instrument of one household's interest over another's, the bargain collapsed. India's Election Commission does not adjudicate quarrels over land, but it adjudicates something just as foundational: whether the losing side in an election believes the result was fairly reached. The Constitution bench now examining the 2023 law is not merely deciding a technical question about who sits on a selection committee. It is deciding whether India keeps the structural distance between appointer and appointed that has, however imperfectly, kept the Commission's verdicts accepted for seven decades. Get that distance right, and the current row over 14 objections becomes what the Commission says it is: ordinary friction inside a functioning institution. Get it wrong, and every future election, regardless of who wins, inherits the same corrosive question Rahul Gandhi is already asking: who is really deciding, and for whom.
