The U.S. Department of Homeland Security has ended a federal rule that allowed immigrants to continue working legally for up to 540 days while the government processed renewals of their work permits. The decision has immediately affected tens of thousands of people, including H-4 visa holders, asylum seekers, and Indian nationals, even though many of their renewal applications remain pending at U.S. Citizenship and Immigration Services due to chronic backlogs.

The 540-day automatic extension had functioned as a safety net for immigrants caught in USCIS's slow processing times. Under the rule, people whose Employment Authorization Documents (EADs) expired while a renewal was pending could continue working legally for up to 18 months, provided they had filed on time. With that cushion now gone, anyone whose permit expires before USCIS finishes adjudicating their renewal loses the legal right to work immediately, regardless of how long the agency takes to act on their case.

Who Is Affected

The policy change affects two primary groups: dependents of H-1B visa holders who hold H-4 status, and asylum seekers awaiting decisions on their claims. H-4 visa holders, many of them spouses of technology workers, had relied on work authorization to hold jobs in the United States while their families waited through multi-year backlogs in employment-based green card processing. Indian nationals represent a significant share of H-1B visa holders, and by extension their H-4 spouses, which is why officials estimate the change will affect tens of thousands of Indian nationals.

Asylum seekers face a similarly precarious situation. Many depend on their work permits not just for income but for maintaining lawful presence and stability while their asylum cases, which can take years to resolve, move through an overburdened immigration court system. Losing that authorization mid-process can mean sudden unemployment and loss of health benefits tied to employment, even for individuals who have complied with all requirements and are simply waiting on the government to act.

A Backlog Years in the Making

USCIS has struggled for years with mounting application backlogs, a problem that worsened during the pandemic and has not fully resolved. Processing times for work permit renewals have in some cases stretched well beyond a year, which is precisely why the 540-day extension was created in the first place: to prevent agency delays from punishing applicants who filed on time and followed the rules.

By removing that buffer without first addressing the underlying processing delays, immigration attorneys argue that the policy effectively penalizes immigrants for USCIS's own inefficiency. An applicant who submits a renewal months in advance can still find their legal work status lapse simply because the agency has not processed their file, through no fault of their own.

Legal Challenges

The rule change has drawn legal challenges. Affected individuals have filed suit contesting the new regulation, arguing that eliminating the automatic extension while processing delays persist causes immediate harm: lost jobs, lost income, and in some cases lost health insurance, for people who have complied fully with federal filing requirements.

The litigation reflects a broader pattern in U.S. immigration policy, where administrative rule changes are frequently met with court challenges from those caught between policy and practice. The outcome of that legal fight will determine whether the 540-day extension is restored or whether immigrants will continue absorbing the risk created by USCIS's backlog.

Why It Matters

For the Indian diaspora in the United States, a community deeply tied to the H-1B visa system and its effects on spouses and families, the policy shift adds another layer of uncertainty to lives already shaped by years-long waits for permanent residency. Beyond the immigration system itself, the change underscores a recurring tension in U.S. policy: rules designed to tighten enforcement often collide with agency infrastructure too slow to keep pace, leaving ordinary applicants to bear the cost.
