The United States has suspended several Indian information technology firms from the EB-5 immigrant investor program, a visa route that grants green cards to foreign nationals who invest in American businesses. The suspension comes amid intensifying political scrutiny of the H-1B visa, the primary channel through which thousands of Indian technology workers enter the United States each year.

The two programs serve different purposes: EB-5 rewards capital investment with permanent residency, while H-1B allows US employers to sponsor skilled foreign workers for temporary jobs, frequently in software engineering and other technical fields where Indian nationals make up the largest share of recipients. Together they form a pipeline that has long linked India's vast pool of technology talent to the American economy, and the suspension signals that pipeline is now under strain from multiple directions.

A Widening Political Target

The EB-5 action follows pointed remarks from Vice President JD Vance, who described H-1B visa holders as "foreign indentured servants." The comment reflects a broader argument, gaining traction across parts of the American political spectrum, that employer-sponsored visa programs depress wages for domestic workers and tether foreign employees to single companies in ways that critics liken to coerced labor.

That critique has found a receptive audience in the current administration, where skepticism of high-skilled immigration has merged with longstanding populist complaints about outsourcing. Indian IT services companies, which have historically used H-1B visas to rotate engineers and consultants into American client sites, have been frequent targets of this criticism because of their outsized share of visa petitions relative to American technology employers.

Echoes of a Longer Pattern

The move is consistent with a pattern in which Washington has used its leverage over global economic rules to advance American interests. During the 1990s and 2000s, the United States used its dominant position in institutions such as the International Monetary Fund and the World Trade Organization to set terms for other countries' economic policies, from debt relief conditions imposed on developing nations to tariffs on steel and textiles that provoked retaliation from trade partners. Immigration policy, unlike trade policy, operates largely outside those multilateral frameworks, giving Washington considerable discretion to adjust the rules governing who may work in the country and on what terms.

For India, the stakes are considerable. The country's technology services industry, anchored by firms that built their business models around sending engineers abroad on temporary visas, has depended on continued access to the American labor market. Any sustained tightening of that access, whether through H-1B caps, enhanced scrutiny, or suspension from adjacent programs like EB-5, threatens a revenue stream that Indian IT companies have relied on for decades.

What Comes Next

It remains unclear how many firms have been affected by the EB-5 suspension or what specific violations or concerns triggered the action. Immigration attorneys and industry groups are likely to seek clarity from US Citizenship and Immigration Services, which administers both programs, on whether the suspension reflects firm-specific compliance issues or a broader policy shift targeting Indian outsourcing companies.

Vice President JD Vance's characterization of H-1B holders as "foreign indentured servants" suggests the administration views the visa system itself, not just individual bad actors, as the problem.

The controversy also puts India's government in a delicate position. New Delhi has generally avoided direct confrontation with Washington over visa policy, preferring quiet diplomacy to public pressure, even as the issue carries significant domestic political weight given how central the IT sector is to India's middle class and export earnings. Whether this latest suspension prompts a more assertive response from Indian officials, or further escalation from Washington, will likely shape the next phase of a relationship that has grown more transactional on both sides of the technology and immigration ledger.
