A taxi aggregator recently suspended a Dalit driver's account for 100 years. Not a fine, not a warning, a century-long banishment issued by an algorithm for the offense of protesting casteism he faced on the job. The number is almost comic in its absurdity, the sort of glitch you'd laugh off if it weren't a livelihood being erased. But the real story isn't the algorithm's arithmetic. It's what the incident reveals about a gap in Indian law that has existed, largely unexamined, for more than seventy years.

India has some of the most ambitious anti-discrimination architecture in the world on paper. Article 17 of the Constitution abolished untouchability outright. The Protection of Civil Rights Act and the SC/ST (Prevention of Atrocities) Act criminalize caste-based humiliation and violence. Yet nearly all of this machinery was built to restrain one actor: the state, or individuals acting in clearly public capacities such as temples, wells, schools, and government offices. It was never designed to reach into a private company's terms-of-service agreement or the black-box logic of a gig-work app. A Dalit driver humiliated by a passenger and then punished by the platform's own moderation system finds himself in a legal blind spot that predates the smartphone by two thousand years.

An Old Wound, Freshly Reopened

To understand why this gap exists, it helps to remember what untouchability actually was and how long it survived. The varna system that hardened in ancient north India divided society into hereditary functional groups: priests, warriors, peasants, and laborers, with an entire class of people placed outside the fourfold order altogether. Crucially, this wasn't merely social custom enforced by habit; it carried the sanction of both state and religion, with religious texts teaching that one should defend one's own dharma rather than adopt another's. That double sanction, sacred and political, is what made caste so durable. It didn't need a police force because it had cosmology.

By the time the British arrived, the system had metastasized into a granular apparatus of exclusion. Historical accounts describe an era in which a Dalit could not draw water from wells used by higher castes, could not enter temples, and often could not send his children to schools attended by caste Hindus. Public services, including the police and the army, were simply closed to him. He was funneled into "unclean" occupations: scavenging, tanning, and the most menial labor a society could invent.

Colonial administrators, for their part, did little to disturb this order and sometimes reinforced it. The Indian Civil Service itself became a case study in exclusionary design: exams held only in London, conducted in English, grounded in classical European learning, with the eligible age cut from 23 in 1859 to just 19 by 1878, effectively locking Indians out. The lesson embedded in that era was that exclusion works best when it hides inside neutral-sounding rules: an age limit, a test location, a language requirement, rather than an explicit caste bar. It's a lesson that echoes uncomfortably in today's platform "community guidelines" and opaque suspension algorithms.

Why the Law Stopped at the Gate

When independent India moved to dismantle untouchability, the reform was framed almost entirely around the state's obligations and the state's wrongdoing, because the state was the visible, accountable target. Nobody in 1950 was drafting statutes to anticipate a ride-hailing app dispatching a driver based on a customer's rating, or an opaque scoring system quietly deprioritizing a worker after a discrimination complaint.

This is not a failure of foresight so much as a mismatch of eras. The framers of the Constitution and the authors of the Protection of Civil Rights Act were responding to a world of wells, temples, and village hierarchies, where a Dalit could not enter Hindu temples or study sacred texts. They were not responding to a world where employment relationships would be mediated by terms-of-service contracts between an individual and a multinational corporation registered abroad, adjudicated by customer-support chatbots rather than magistrates.

The gig economy has quietly re-created exactly the kind of unaccountable private power that pre-modern India knew intimately. Gig workers are classified as independent contractors rather than employees, which strips away not only labor protections but also many of the anti-discrimination frameworks that attach to formal employment. A driver isn't fired by a company he can sue for wrongful termination; he is "deactivated" by a platform whose internal grievance process may amount to an appeals form and a form-letter response. When that deactivation follows a complaint about caste discrimination, the irony is almost too on-the-nose: the very act of resisting casteism becomes the trigger for a private, extra-legal punishment that the state's civil rights statutes were never built to touch.

The Sub-Caste Trick, Reinvented

There's a historical pattern worth noting here. In periods of social expansion, castes proliferated into countless sub-castes as foreign groups were assimilated and tribal peoples absorbed into brahmanical society, with tribal chiefs granted respectable status while ordinary tribesmen were assigned low rank. Each tribe became its own separate caste. The system's genius, if it can be called that, was its capacity to keep fragmenting identity so that no unified class of the exploited could ever combine against the privileged.

Modern platform capitalism performs a strange echo of this fragmentation. Instead of sub-castes, we get individualized "trust scores," opaque rating systems, and algorithmic sorting that atomizes workers so thoroughly that they rarely know whether their treatment is personal misfortune or a pattern affecting thousands of others like them. A driver suspended for protesting casteism has no union hall to walk into, no collective body of fellow drivers to corroborate his account, no legal category under Indian law that clearly says: this too is untouchability, just wearing a hoodie instead of a sacred thread.

What a Fix Would Require

None of this argues for nostalgia about state power. Governments have their own long, ugly history of enabling discrimination, sometimes through neglect and sometimes through active collusion with orthodox social forces. The state is not a natural ally of the marginalized; it has to be forced into that role by law, litigation, and organizing, which is exactly how the Protection of Civil Rights Act and the Atrocities Act came to exist in the first place.

But that history is precisely why the current gap matters. India built one of the most detailed legal vocabularies in the world for describing what caste discrimination looks like: exclusion from wells, temples, schools, and public employment. It has almost no equivalent vocabulary for what caste discrimination looks like when the excluding party is a private platform whose "public square" is a rating algorithm and whose "well" is an app's dispatch queue. Extending anti-discrimination law to reach private employers, and especially to reach the platforms that increasingly structure gig work, is not a radical proposition. It is simply catching statutory language up to where economic power actually lives in 2024.

The 100-year suspension will likely be reversed, quietly, once the story generates enough attention. But the loophole that made it possible will remain, waiting for the next driver, the next delivery worker, the next person who discovers that the Constitution's promise of dignity, however hard-won across decades of struggle, still stops at the company gate.
